Approximately one year ago, I purchased a home in Indio, California and was represented by Joseph Malera. I purchased the home with another individual and it was a 50/50 purchase agreement.

The other owner of the home decided they wanted to sell there half of the home this past September. At this time, I decided to purchase the entire home. Once again I was represented by Joseph Malera. He charged me a large fee and did not represent me, but instead represented the seller.

The following took place during this transaction. The agent (Joseph Malera) participated in unethical real estate practices and admitted to it.

1. He did not represent me with the title company involved. I was not kept abreast of monies transferred, date of closing, etc.

2. I was never allowed to do a professional walk through prior to purchasing the home. He just sent pictures with a visual inspection done by the seller and himself.

4. He also did not have any of the correct money information in the escrow account. He was trying to handle transactions with the seller without consulting with me, the buyer. I was paying all fees.

5. He was dishonest in a transaction relating to a golf cart that was to be paid for at closing. He said that he would have a fed ex envelope to mail the monies at walk through, neither took place.

Buyer and Seller Beware! Do not buy or sell a house with Joseph Malera.

There is a review on this Broker (Mr. Joseph Melara) by Ms. Francine Failoni that is totally and utterly inaccurate. I am the other person Ms. Failoni purchased the home with, so I know the “true” details. Initially I was not selling my half to her. We were going to put the house on the market because Ms. Failoni and I were splitting up, and Joseph Melara was to be the selling agent. Then Ms. Failoni decided she wanted to buy me out. And he never did anything unethical — that is a “lie”. Ms. Failoni’s review list 4 items. I will address them one by one:
1. The title company involved represented both myself and Ms. Failoni. They kept us both up to date on everything involved. Ms. Judy Hathaway of Equity Plus can “verify” that fact. Ms. Failoni frequently ignores Emails and Text message. She is very difficult to reach
2. And she was offered a “Walkthrough” and I am sure Mr. Melara can provide written proof. He sent her a message (and also sent it to her sister who lives in the same development) offering a walkthrough at their leisure. Since I left the home a few days before closing, he sent photos to “prove” (at my request) I left the house in excellent shape.
3. There is no 3
4. Equity Pus handled all the financial information. And Ms. Failoni paid all the fees because I refused to pay any of them. The house was worth much more than the amount she was paying me, so I told her I would not pay any fees, Mr. Melara had nothing to do with that. Once again, totally inaccurate account of what transpired.
5. The Golf Cart sale was initially in the sales contract. Ms. Failoni made him take it out, and stated “in writing” she would provide the money at closing. I left Mr. Melara the FEDEX envelop to mail the check to me in North Carolina. There was never any mention of providing it at a walkthrough. Ms Failoni was not even in California at closing. And she DID NOT provide a check at closing for the Golf Cart. It took me a week after closing of badgering her to get her to honor her commitment. Her review of Mr. Melara is disrespectful and dishonest. AND I WOULD SWEAR TO MY REVIEW UNDER OATH.
